1. Scope of Services

These Terms & Conditions govern the use of this website and the services provided by Medi Guide India (“FACILITATOR”, “we”, “our”).

The FACILITATOR acts solely as a medical tourism facilitator and coordinator and provides non-medical services only, including:

  • Hospital introductions and referrals

  • Appointment and treatment coordination

  • Communication and logistical assistance

We do not:

  • Provide medical treatment, diagnosis, or healthcare services

  • Employ, control, or supervise hospitals, doctors, or medical professionals

  • Guarantee medical outcomes, recovery, or results

All medical services are rendered independently by licensed hospitals and doctors.


2. No Medical Advice & No Guarantee

All information provided on this website or through our representatives:

  • Is for informational and facilitation purposes only

  • Shall not be construed as medical advice, diagnosis, or treatment

All medical decisions, procedures, risks, and outcomes remain solely between the patient and the treating hospital or doctor.


3. Limitation of Liability

The FACILITATOR shall not be liable for:

  • Medical negligence, malpractice, or clinical complications

  • Treatment outcomes or post-treatment dissatisfaction

  • Hospital pricing changes, refunds, or billing disputes

  • Acts, omissions, or representations of hospitals, doctors, or referral agents

Any liability, if established under applicable law, shall be limited strictly to the facilitation fee paid to the FACILITATOR.


4. Payments, Fees & No-Chargeback Policy

All payments made to the FACILITATOR are:

  • For facilitation and coordination services only

  • Non-refundable

  • Non-reversible

By making a payment, the user expressly agrees that:

  • No chargebacks, reversals, or payment disputes shall be initiated

  • Hospital treatment fees are billed separately by hospitals and are not controlled by the FACILITATOR


5. Payment Compliance & Regulatory Safeguards

5.1 Authorized Payment Channels

All payments shall be made only through authorized banking or payment channels, including regulated banks and approved payment gateways linked to the FACILITATOR’s account.

The FACILITATOR strictly prohibits:

  • Cash payments (in any currency)

  • Hawala or informal remittance channels

  • Cryptocurrency or unregulated digital wallets

  • Third-party payments without appropriate KYC

Any attempt to use prohibited payment methods may result in immediate termination of services without liability.


5.2 No Forex or Remittance Services

The FACILITATOR:

  • Does not provide foreign exchange, remittance, or money transfer services

  • Shall not be construed as an Authorized Dealer, Payment Aggregator, Money Service Business, or Forex Agent

All currency conversion and remittance activities are carried out exclusively by banks or authorized financial institutions.


5.3 Compliance Declaration

The user confirms that all payments:

  • Are lawful and compliant with applicable foreign exchange, banking, AML, and KYC regulations

  • Are made solely for legitimate facilitation services

Any regulatory or legal violation arising from payment methods or declarations shall be the sole responsibility of the payer, not the FACILITATOR.


5.4 Nature of Consideration

Payments received by the FACILITATOR constitute consideration for facilitation and coordination services only.

The FACILITATOR shall not be responsible for:

  • Hospital treatment charges

  • Medical billing classifications

  • Hospital tax or regulatory compliance


5.5 AML, KYC & Regulatory Cooperation

The FACILITATOR reserves the right to:

  • Conduct basic KYC verification

  • Reject, delay, or refund payments flagged by banks or payment gateways

  • Cooperate with financial institutions or regulatory authorities

Such actions shall not create any liability on the FACILITATOR.


5.6 Indemnity

The user and/or hospital agrees to fully indemnify and hold harmless the FACILITATOR against:

  • Regulatory penalties

  • Banking or payment gateway disputes

  • Investigations or enforcement actions

arising from non-compliant payment methods, incorrect declarations, or unlawful remittances.


6. Referral & Overseas Agents

Any referral or representative:

  • May only refer patients

  • Shall not provide medical advice or guarantees

  • Bears full liability for misrepresentation

Such agents agree to indemnify the FACILITATOR against all related claims.


7. Force Majeure

The FACILITATOR shall not be liable for delays or failures caused by events beyond reasonable control, including:

  • Pandemics or epidemics

  • Visa or immigration issues

  • Government actions or regulatory changes

  • Natural disasters or medical emergencies


8. Governing Law & Jurisdiction

These Terms shall be governed by applicable laws of India, and exclusive jurisdiction shall lie with courts in India only.
